Terms & Conditions

Tortrivora d.o.o. (hereinafter: "the Company") provides a digital platform for real estate crowdfunding that enables users to participate in real estate investment projects in the Republic of Croatia and beyond. The platform is intended for adult natural persons and legal entities.

By using our platform, you confirm that you have read, understood, and accepted these terms and conditions. If you disagree with any part of these terms, please do not use our platform.

"Platform" refers to the website tortrivora.com and all related applications and services. "User" refers to any natural or legal person who accesses or uses the Platform. "Project" refers to a real estate investment opportunity published on the Platform. "Investment" refers to the User's financial contribution to a selected Project through the Platform.

The User undertakes to use the Platform in accordance with applicable laws of the Republic of Croatia and the European Union, including but not limited to anti-money laundering regulations, consumer protection, and data protection regulations.

It is prohibited to use the Platform for illegal purposes, for transmitting harmful software, for compromising the security of the Platform, or for any activities that could damage the Company, other users, or third parties.

Access to certain functionalities of the Platform requires registration and opening a user account. The User is obliged to provide accurate, complete, and up-to-date information during registration and to update it regularly.

The User is responsible for maintaining the confidentiality of their access credentials and for all activities that occur through their user account. In case of suspected unauthorised use of the account, the User is obliged to immediately notify the Company.

Investing in real estate projects through crowdfunding carries inherent risks, including but not limited to: the possibility of partial or total loss of invested capital, delays in project realisation, changes in market conditions, and changes in the regulatory environment.

The Company does not guarantee return on investment or achievement of any profit. Each User makes investment decisions at their own risk. We recommend carefully considering your financial situation before investing and seeking independent financial advice if necessary.

All content on the Platform, including but not limited to texts, graphics, logos, icons, images, audio and video materials, software, and databases, is protected by the intellectual property rights of the Company or third parties.

Without prior written approval from the Company, copying, reproducing, distributing, publishing, or any other use of content from the Platform for commercial purposes is prohibited.

The Company provides the Platform "as is" and "as available". The Company makes no warranties, express or implied, regarding the accuracy, completeness, or timeliness of information on the Platform.

To the maximum extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use the Platform.

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms and Conditions. By using the Platform, you confirm that you are familiar with our Privacy Policy.

The Company reserves the right to amend these Terms and Conditions at any time. Users will be notified of significant amendments through the Platform or by email at least 30 days before the amendments take effect.

Continued use of the Platform after the amended terms come into effect is considered acceptance of such amendments. If you disagree with the amendments, you have the right to cease using the Platform and close your user account.

These Terms and Conditions are governed by the laws of the Republic of Croatia. All disputes arising from or related to these terms shall be subject to the jurisdiction of the competent court in Zagreb, Republic of Croatia.

Before initiating legal proceedings, the parties undertake to attempt to resolve the dispute amicably within 30 days of written notice of the dispute.
